August 21, 2008 Casey was released from prison after a bounty hunter from California paid the $500,000 bail. On 27 August, a test detected traces of decomposition in Casey’s car and two days later, her bail was revoked, forcing her to return to prison. Released shortly after, she returned to prison on 15 September, still on charges of fraud, theft, negligence, and obstruction of justice. Although no body has been found yet, Casey was formally charged with first degree murder, gross abuse of a minor, homicide, and four counts of lying to investigators over the disappearance of her daughter. Casey was arrested again, but this time, no bail was possible. In November, a judge refuses to deal with accusations of fraud and states that the first trial for first degree murder, in January 2009.
